In "Roberts v. Roberts" PJM's Rick Richman presents the colloquy between the Solicitor-General and Roberts at the oral argument on O-Care. It shows skeptical queries from Roberts, making the very arguments he rejected upon switching sides.
In an earlier post at Commentary Blog Richman detailed another semantic evasion re taxes by Team Obama when passing O-Care, in which a Medicare tax was renamed a "contribution." That label can only legitimately apply if the funds go to Medicare. In fact, they went into general revenues--the epitome of what constitutes taxation.
Bottom Line. Roberts thus saved a law passed with stealth taxation at its core. Rewarding governmental deception is no way to improve the country's condition.
